1. Introduction

Welcome to Vellum Select. These Terms of Service ("Terms") govern your access to and use of the Vellum Select website and platform (the "Platform"), operated by Endor Bilisim, registered at Esentepe Mah. Talatpasa Cad. No: 5 / 1, 34394 Sisli/Istanbul, Turkey ("we", "us", "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

2. Nature of Our Service

Vellum Select is an information and connection platform. We help users discover specialist doctors and clinics and submit inquiries to them through our inquiry form.

We are not a medical provider. We do not provide medical advice, diagnosis, treatment, or any healthcare services. We do not employ the doctors or operate the clinics listed on the Platform. The doctors and clinics featured on Vellum Select are independent third parties who are solely responsible for the medical services they provide.

3. Eligibility

To use the Platform you must be at least 18 years old and legally capable of entering into a binding agreement. By using the Platform, you confirm that you meet these requirements.

4. Inquiries and Communication

When you submit an inquiry through the Platform, you authorise us to share your information with the doctor or clinic relevant to your inquiry, as described in our Privacy Policy. The doctor or clinic will then contact you directly to continue the conversation.

You are responsible for the accuracy of the information you submit. We are not responsible for any consequences arising from inaccurate, incomplete, or misleading information provided by you.

5. No Medical Advice

Any content on the Platform, including doctor profiles, treatment descriptions, articles, and informational pages, is provided for general informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Platform.

6. Relationship Between You, Doctors, and Clinics

Any agreement, consultation, treatment, payment, or service arrangement is strictly between you and the doctor or clinic you choose to engage with. Vellum Select is not a party to that relationship.

We do not guarantee:

The availability, qualifications, or conduct of any doctor or clinic.
The outcome, quality, or safety of any medical procedure or treatment.
The accuracy of pricing, scheduling, or other details communicated by a doctor or clinic.

Any disputes regarding medical services, billing, or treatment outcomes must be resolved directly between you and the relevant doctor or clinic.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Endor Bilisim or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

8. Acceptable Use

You agree not to:

Use the Platform for any unlawful, fraudulent, or harmful purpose.
Submit false, misleading, or impersonated information.
Attempt to gain unauthorised access to any part of the Platform or its systems.
Interfere with the operation of the Platform, including through bots, scrapers, or denial-of-service attempts.
Use the Platform to send spam, marketing, or solicitations to doctors or clinics.

We reserve the right to suspend or terminate access for any user who violates these Terms.

9. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy practices, or actions of any third-party sites or services.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Endor Bilisim, its affiliates, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or any damages arising out of or in connection with:

Your use of, or inability to use, the Platform.
Any medical services, advice, or treatment provided by a doctor or clinic listed on the Platform.
Any communication or transaction between you and a doctor or clinic.
Any unauthorised access to or alteration of your data.

12. Indemnification

You agree to indemnify and hold harmless Endor Bilisim and its affiliates, officers, employees, and partners from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your interactions with any doctor or clinic.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal data. By using the Platform, you consent to those practices.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on this page with the updated date shown above. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
